15-year land rental exemption proposed for agribusiness

The Ministry of Finance is seeking public comments on a draft decree that outlines additional cases where land use fees and land rental fees will be exempted or reduced.

The draft decree has been prepared on the basis of Clause 2, Article 157 of the Land Law and aims to amend and supplement specific aspects regarding land use fees, land rental fees, and the Land Development Fund as regulated in Decree No 103/2024/ND-CP and Decree No 104/2024/ND-CP.

The proposed decree focuses on land rental fee exemptions and reductions for businesses investing in agricultural projects and rural development areas, in accordance with the Government's regulations aimed at encouraging business investment in these sectors.

Key points of the draft decree include:

Agricultural projects with investment incentives and encouraged investments will benefit from land rental fee exemption during the basic construction period.

Agricultural projects that qualify for investment incentives will receive a land rental fee exemption for 15 years, following the basic construction period, along with a 50% reduction of land rental fees for the subsequent 7 years.

Agricultural projects with encouraged investment will enjoy an 11-year land rental fee exemption, followed by a 50% reduction for the next 5 years.

Newly established small and medium agricultural enterprises will benefit from a 5-year land rental fee exemption and a 50% reduction for the following 10 years.

The list of agricultural projects that qualify for special investment incentives, investment incentives, encouraged investments, and newly established small and medium agricultural enterprises will be determined according to the Government's regulations on mechanisms and policies to foster business investment in agriculture and rural areas.
