One of the new highlights of the Law amending and supplementing a number of articles of the current Law on Technology Transfer is that foreign-invested enterprises transferring technology to domestic businesses will be eligible for preferential policies.
Mr. Chu Thuc Dat, Deputy Director of the Ministry of Science and Technology's State Agency for Technology and Innovation, provided this information at the ministry's regular press conference on September 26.
The objective of the amendment and supplementation is to continue improving the legal framework for technology transfer, simplifying administrative procedures, developing the science and technology market, and promoting innovation and technology transfer for businesses, organizations, and individuals.
The draft focuses on amending and supplementing six main new policy groups:
First, the scope of technology regulated by the Law has become more comprehensive, with additional definitions and new technologies such as strategic technology and green technology.
Second, promoting endogenous technology transfer, including technology transfer among domestic enterprises/organizations and individuals, and commercializing research and development results. This includes provisions on technology ownership and usage rights, contributing capital to investment projects through technology, and amending/supplementing technologies encouraged for transfer.
Third, the development of the science and technology market is oriented towards becoming more professional and transparent.
Fourth, creating financial, institutional, and legal incentives for technology transfer.
Fifth, to ensure technology security and enhance the effectiveness of international cooperation, with additional regulations on controlling cross-border technology transfer, including transfer from Vietnam abroad, while amending and supplementing prohibited acts in this field.
Sixth, strengthening regulations on monitoring, statistics, and measuring the effectiveness of technology transfer.
In October 2025, alongside the Law amending and supplementing a number of articles of the Law on Technology Transfer, the ministry will interprete comments from the National Assembly (NA) Standing Committee to finalize three other draft laws: (1) Law amending the Law on High Technology; (2) Law amending and supplementing a number of articles of the Law on Intellectual Property; and (3) Law on Digital Transformation. This ensures timely submission to the NA for consideration and approval at the upcoming 10th session of the 15th NA.
