Scope of construction works exempted from permits to be expanded

During the National Assembly (NA)'s group discussion on the draft Law on Construction (amended), that took place on November 6, many NA  deputies expressed agreement with the policy of expanding the scope of construction projects to be exempted from building permits.

Deputy Nguyen Phi Thuong (Hanoi delegation) noted that the draft law clearly defines the cases to be exempted  from permits and the responsibilities of investors. However, he suggested adjusting the process to be interconnected from the approval of investment policy to the commencement of construction to avoid repetitive procedures. 

He also proposed adding a requirement for basic design in the project proposal dossier so that specialized agencies can appraise it right from the policy approval stage in order to shorten the time and eliminate duplicate procedures.

Deputy Do Duc Hong Ha (Hanoi delegation) observed that the regulation of permit exemption but still requiring submission of documents equivalent to those for a building permit application is merely formal and does not truly reduce procedures. He proposed two options: either remove the requirement to submit accompanying documents or, if still needed, only require a minimal set of documents, such as approved design drawings, instead of the full dossier as before.

Meanwhile, Deputy Hoang Van Cuong (Hanoi delegation) suggested further expanding the subjects to be exempted from building permits, but the projects must still have designs for which the consulting unit is responsible, ensuring technical safety and compliance with planning. 

According to Deputy Nguyen Ngoc Son (Hai Phong delegation), the mechanism of permit exemption and construction commencement notification is an important reform that helps reduce pre-inspection. However, it is necessary to clearly define the dossier, processing time, and integrate procedures on the Public Service Portal to ensure consistency and transparency.
