New regulations on foreign worker management

Over 121,200 foreigners now working in Vietnam.

Departments of Labor, Invalids and Social Affairs in cities and provinces will be in charge of managing foreign workers in their localities under a new Government Decree.

The government has recently issued Decree No. 70/2023/ND-CP amending and supplementing a number of articles in existing Decree No. 152 on regulations for foreigners working in Vietnam and the management of Vietnamese nationals working for foreign employers in Vietnam.

Under the decree, the Ministry of Labor, Invalids and Social Affairs (MoLISA) will be responsible for the common management of foreign workers around the country, to ensure smooth and comprehensive management from the central level to localities.

Regarding foreigners working in Vietnam, at least 15 days before the expected date of employment of foreign workers, an employer (except for contractors) must submit a report to MoLISA or Departments of Labor, Invalids and Social Affairs in localities involved.

When there is a change in position, job title, form of work, or location as well as the number of foreign workers, the employer must inform related agencies at least 15 days before the expected date of employment of foreign workers. These agencies are required to notify the employer of approval or otherwise within ten working days.

As of the end of June, there were over 121,200 foreigners working in Vietnam, according to MoLISA.
