The Ministry of Home Affairs has requested that local People's Committees at provincial and city levels direct their Departments of Home Affairs to take the lead in coordinating with relevant departments and agencies to enhance inspections and supervision of the implementation of legal regulations on foreign labor at agencies, organizations, enterprises, and contractors within their jurisdictions, including in the tourism sector.
Authorities are required to proactively and timely detect and strictly handle cases where foreigners work without permits, illegally, or for purposes inconsistent with their entry visas.
This directive implements the guidance from Deputy Prime Minister Mai Van Chinh as stated in Official Dispatch No. 6741/VPCP-KGVX, dated July 21, 2025, on strengthening State management and improving economic efficiency in activities related to receiving international tourists in Vietnam.
Relevant authorities must also disseminate information, provide guidance, and popularize legal regulations concerning foreign workers in Vietnam, particularly the 2019 Labor Code and the Government's Decree No. 219/2025/NĐ-CP, dated August 7, 2025, which regulates foreign employees working in Vietnam.
Additionally, a review and evaluation of the implementation of local coordination mechanisms for managing foreign labor must be carried out. This aims to strengthen the management of foreign workers and to clearly define the specific responsibilities of each relevant local department and agency.
Authorities must strictly comply with all relevant legal provisions for foreign laborers working in the tourism sector.
The assessment of demand for foreign labor must be conducted, and work permits should only be granted for positions such as managers, executive directors, experts, and technical workers in the tourism field that Vietnamese labor cannot fill, and only when applications are complete and meet all regulatory requirements.
