Minister of Science and Technology Nguyen Manh Hung, authorized by the Prime Minister, on October 27 presented a proposal for the amendment and supplementation of certain provisions of the Intellectual Property Law to the ongoing sitting of the 15th National Assembly.
The proposal stated that to achieve the goal of becomming a digital nation by 2030, Vietnam must develop a digital government, digital economy and digital society. The Intellectual Property Law therefore needs to be improved to ensure the implementation of international commitments in the context of changing world trade practices.
According to the minister, the draft amendment of the Intellectual Property Law focuses on five main policy groups, including a complete and clear legal basis for protecting industrial property rights, as well as "updating new issues in intellectual property protection in the world in accordance with Vietnam's policies and socio-economic development level."
Minister Hung stated that the draft law amends and completes regulations on protection of industrial designs for user interface designs, and other virtual assets.
The proposal emphasizes the reason for the amendment to create a legal basis for commercial exploitation of intellectual property rights, ensuring compliance with civil law and international commitments.
Regarding new additional content, the draft law supplements regulations on handling intellectual property right (IPR) conflicts to facilitate commercial exploitation; supplements more policies of the State in supporting the creation and commercial exploitation of intellectual property objects to promote innovation.
The National Assembly's appraising agency recommended that the drafting agency continue to research, review, and complete the draft law's regulations related to artificial intelligence to meet development requirements, and protect legal rights and interests of rights holders.
