New legal instrument on land, minus certain articles to take effect from this April 1, will come into force on January 1, 2025 following approval from the National Assembly.
The Ho Chi Minh City Real Estate Association (HoREA) has made a number of proposals to the National Assembly’s Standing Committee regarding amendments to the Land Law, including that it not be compulsory to conduct real estate transactions through a trading floor because this would create “privileges” for the floor and “deprive” project investors of their business autonomy.
The Ministry of Natural Resources and Environment has said that the draft revised Land Law has eight important new points, such as institutionalizing the policy on abolishing land price brackets; introducing mechanisms and methods to determine land prices according to market principles; and establishing a synchronous legal corridor to shift the focus from administrative-heavy management methods to the use of economic tools to manage and regulate land relations, among others.
On August 8, while working with the Ministry of Natural Resources and Environment on amending and supplementing the Land Law, National Assembly (NA) Chairman Vuong Dinh Hue emphasized that the revised law is extremely important and the draft will be considered and discussed by the NA at three sessions, not at one session, as with other bills. The goal is to complete the adjustments of related laws next year.
